Changes to Data Protection Laws

 

These new laws came into effect on May 25, 2018 in regard to data collected by myself on you at time of consultation, how it’s kept, what is kept and what it’s used for.  It is also designed to give you more choice on how I contact you and how I use your data.

At the first appointment with any new client I fill out the relevant consultation sheet to the relevant therapy for which you are being seen.  This will include your personal details, medical history and what it is you are seeking treatment for.

This information is to enable me to provide the correct health service to my clients (if at all), to maintain records and accounts and to promote my services.   These arecords are not digitised in any way, not sold to third parties for any reason and are kept at my home where only I have access to them.

The only occasion that I would give your information to a third party is in the circumstances of a solicitors request in regard to an accident claim for example, but you would have to sign a declaration of release form prior to my releasing of your records.

My insurance company, Balens Ltd who provide my work cover and are underwritten by Zurich Insurance Plc, require that my records are kept for at least seven years fllowing the last occasion on which therapy was given.  In the case of minors, it is advisable that records should be kept for at least seven years after they reach the age of eighteen years.

This is only a guide as much advice given prior to these new laws was that therapists should keep all records until seven years post trading, now it it up to the individual as to whether or not the records are kept for longer than the seven years stated.  I generally do as do most therapists, for my part, it is because I still get returning clients after many years absence and this stops the need to go through another consultation.

The Inland Revenue also state that I should keep my accounts for a minimum of seven years after I cease trading as a therapist.

If you wish to opt out of any occasional marketing I carry out then please inform me, the same for destroying your notes after the seven years.
